Website & App Terms of Use & Terms of Business

These Terms of Use and Terms of Business (“Terms”) govern your access to and use of:

  • www.theintrinsicathlete.com (the “Website”)
  • The Intrinsic Athlete mobile application and coaching platform (“App”)
  • All related digital systems, third-party integrations, content, and materials
  • All online and in-person coaching services, programs, and products provided by Intrinsic Athlete Ltd

By accessing or using any Intrinsic Athlete platform, purchasing a product, or engaging in any service, you agree to be legally bound by these Terms. If you do not agree, discontinue use immediately.

You must also review our Privacy & Data Protection Policy, which complies with PIPEDA (Canada) and explains how your information is collected, used, and protected.

1. Health Disclaimer & Scope of Practice

Intrinsic Athlete Ltd and its representatives:

  • do not provide medical advice, diagnosis, or treatment
  • are not licensed medical professionals, physiotherapists, dietitians, or regulated healthcare providers
  • provide general fitness training, nutrition education, and lifestyle guidance only

All programs, recommendations, and communications are educational and must not replace advice from licensed healthcare professionals.

Before beginning any exercise program, nutrition plan, or supplement routine, you should first consult your physician—especially if pregnant, postpartum, injured, on medication, or managing a medical condition.

By using IA services, you accept full responsibility for your health decisions.

2. Eligibility & User Responsibilities

By using the Website or App, you confirm that:

  • you are at least 18 years old
  • the information you provide is accurate and up to date
  • you will disclose relevant medical conditions, limitations, or injuries
  • you understand that participation is voluntary and at your own risk

You agree not to share your account, purchased programs, or proprietary materials.

3. Services Provided

Intrinsic Athlete Ltd provides online and in-person services including:

  • digital training programs
  • movement, mobility, and recovery guidance
  • online personal training
  • nutrition education (non-clinical)
  • IA Library digital modules
  • habit coaching
  • behaviour change support
  • tailored program design
  • group-delivered training with individual coaching support

We may modify or discontinue components of the Services at any time.

4. Fees, Payments & Billing

All prices are presented on the Website or in written consultation.
By purchasing a service, you authorize Intrinsic Athlete Ltd or its payment processor to charge your payment method.

Taxes may apply per provincial legislation.
Pricing may be updated for future purchases.

5. Refunds, Cancellations & Service Termination

5.1 14-Day Right to Cancel (Canadian Consumer Protection)

You may cancel within 14 days only if:

  • intake forms have not been completed, and
  • personalized programming has not been delivered

Once personalized material is delivered, cancellation rights expire.

5.2 8-Week Programs

Non-refundable once any portion is delivered.

5.3 Monthly 1-to-1 Online Coaching

Non-refundable once the monthly program is delivered.
Cancel future months anytime before the next billing cycle by emailing:

5.4 IA Institution Packages

  • Require 30 days’ notice for cancellation
  • Prepaid months may be refunded at the discretion of the owner (Jak Wawrzyniak)

5.5 In-Person Training Sessions

  • Fully refundable only before the first session
  • Medical cancellations may be considered with documentation

6. Technology, App Use & Third-Party Integrations

Intrinsic Athlete uses third-party platforms (including PT Distinction, MyFitnessPal, and others) to deliver services.

By using the App or Website, you acknowledge and accept that:

  • third-party outages, syncing failures, or technical issues may occur
  • your device, operating system, or app version may affect performance
  • Intrinsic Athlete is not liable for disruptions caused by external providers
  • platform functionality may change or update without notice

You agree to comply with all third-party terms of use.

7. Prohibited Conduct

You agree not to:

  • upload or transmit viruses or malicious code
  • attempt unauthorized access to any IA system or server
  • extract, scrape, or copy content
  • reproduce or distribute proprietary materials
  • use IA content for competing commercial purposes

Violations may result in immediate termination and legal action.

8. Availability of Service

We aim to provide uninterrupted access but do not guarantee:

  • continuous or error-free operation
  • compatibility with all devices
  • uninterrupted third-party integrations

Temporary interruptions for maintenance or upgrades may occur.
Interruptions do not constitute breach of contract.

9. Limitation of Liability (Canada-Compliant)

To the fullest extent allowed under Canadian law, Intrinsic Athlete Ltd is not liable for:

  • injuries from exercise
  • improper movement execution
  • training decisions made without medical clearance
  • inaccurate user-provided information
  • indirect or consequential damages
  • technology failures
  • syncing issues
  • expectations regarding results or timelines

We do not guarantee:

  • weight loss or fat loss
  • muscle gain
  • performance outcomes
  • injury prevention
  • changes to habits or lifestyle
  • progress within a specific timeframe

Nothing excludes liability for:

  • negligence causing death or personal injury
  • fraud or fraudulent misrepresentation

10. Results Disclaimer

Results vary due to individual factors such as effort, adherence, genetics, health conditions, lifestyle, sleep, and stress.

Testimonials represent individual experiences and do not guarantee similar results.

11. Data Protection (PIPEDA-Compliant)

Intrinsic Athlete Ltd collects, stores, and processes personal information according to PIPEDA.

You consent to:

  • electronic communication
  • data being stored in Canada or internationally depending on service providers
  • processing required to deliver purchased services

You may request access, correction, or deletion per PIPEDA regulations.

12. Intellectual Property

All Intrinsic Athlete content—including programs, documents, videos, modules, branding, and IP—is owned by Intrinsic Athlete Ltd and protected by Canadian and international copyright law.

You may not copy, share, distribute, or sell IA materials without written permission.

If you voluntarily submit photos, videos, or testimonials and grant consent, you provide IA with a perpetual, royalty-free, worldwide licence to use that content for marketing purposes.

13. International Use

Users outside Canada agree to comply with:

  • local laws
  • Canadian law governing digital services
  • cross-border commerce rules

14. Governing Law

These Terms are governed by the laws of British Columbia, Canada, and applicable federal law.
You agree to the exclusive jurisdiction of the courts of British Columbia.

15. Force Majeure

Intrinsic Athlete Ltd is not responsible for delays or failures resulting from events beyond reasonable control, including:

  • outages
  • cyberattacks
  • pandemics
  • natural disasters
  • system failures
  • labour disruptions
  • government restrictions

16. Modifications to Terms

We may update these Terms at any time.

Continued use of IA services after updates constitutes acceptance.
